· Laws and Regulations in SIP
1)What are the main laws concerning employment and labor management in Suzhou Industrial Park?
A:In SIP, we mainly follow three kinds of laws and regulations. They are: The Labor Law of the People’s Republic of China; The Labor Contract Regulation in Jiangsu Province and The regulation on labor management in Suzhou Industrial Park.
2)What are the main contents in China Labor Law?
A: The Labor Law mainly contains the items including labor contract, working hours and holidays, labor safety and protection, salary and wages, social security and welfare, vocational training, labor disputes and etc.
3)What is China’s working hour system?
A:Working hours are 8 hours per day and 40 hours per week.
4)How about overtime and overtime pay?
A:According to China labor law, overtime shall not exceed 1 hour per day. Under special situation, overtime shall not exceed 3 hours daily. Overtime on weekdays, the overtime pay is 150% of the salary, on weekends, 200% of the salary and 300% of the salary of overtime in public holidays.
5)What are China’s public holidays and how many days?
A: There are altogether 10 public holidays in China. They are : Spring Festival ( 3 days) , Labor Day (3 days), National Day (3 days) and New Year Day (1 day).
6)What’s the regulation on the period of probation?
A: According to the Labor Contract Regulation in Jiangsu Province, the probation period should not exceed 15 days if the contract time is not exceeding 6 months; the probation period should not exceed 30 days if the contract time is over 6 months and not exceeding 1 year; the probation period should not exceed 60 days if the contract time is over 1 year and not exceeding 3 years. The maximum for probation period is 180 days.
7)Can employer terminate the labor contract during probation period?
A: Yes, Article 25 in China Labor law lists that employer can terminate the labor contract during probation period.
